Landlord’s Responsibilities

Before Letting

Register in Scottish Landlord Register

Under Part 8 of the Antisocial Behaviour etc. (Scotland) Act 2004, before you can rent out your property you must register as a landlord. It's a criminal offence to rent out a property without being registered. You can be fined up to £50,000.

· Email address

· Your addresses for the past 5 years

· Addresses of all your rental properties

· Gas safety certificate

· Electrical installation condition report or a current electrical installation certificate

· Electrical appliance test details

· Fire, smoke and heat detection details

· Carbon monoxide

· Public water supply

· Energy performance certificate

· Legionella risk assessment

· Rental property insurance

During the Tenancy

There are a variety of repairs and maintenance tasks that fall within your responsibility as a landlord. These tasks include the maintenance of the building, as well as the electrical wiring, plumbing, heating, and hot water systems.

End of Tenancy

Under the Private Residential Tenancy (PRT), a landlord can only end a tenancy by issuing a Notice to Leave citing one of the 18 available grounds, such as intending to sell the property, refurbish it, or a family member moving in, or due to reasons like rent arrears or antisocial behaviour by the tenant. If a landlord issues a notice to leave without a valid ground, the tenant can challenge it at the First-tier Tribunal for Scotland (Housing and Property Chamber), which can award compensation up to six months' rent.
